According to the interim final rule, The Agriculture Improvement Act of 2018 does not affect the control status of synthetically derived tetrahydrocannabinols because the statutory definition of ‘hemp’ is limited to materials derived from the plant Cannabis sativa L. For synthetically generated tetrahydrocannabinols, the concentration of Δ9-THC is not a decisive factor in whether the material is a prohibited substance. All synthetically derived tetrahydrocannabinols remain controlled substances under Schedule I. In essence, delta 8 THC is federally legal. However, Caulkins et al. (2015) noted that some states or jurisdictions still prohibit the use of delta 8 THC, such as Alaska, Arizona, California, Kentucky, and Idaho, among others.
